Naturalization Application Approved for LPR Whose Case was Denied Before due to Evidentiary Issues
Location: New York City, NY

Our client became a lawful permanent resident in 2007 based on the marriage to his U.S. citizen wife.  Five years had passed since he was issued a green card, and he came to our office for help to file his naturalization application.  He had previously filed his application in 2010 because he was eligible to apply three years after getting his green card since he was still married to his U.S. citizen wife.  His application was denied, however, because the Service concluded that he did not provide enough evidence to show he was living in marital union with his wife.  Our client was living apart from his wife because of his job in a different state at the time of filing the application.

Our client came to our office for help to file the second time.  We prepared the naturalization application along with all supporting documents.  Our client was still living apart from his wife and had some overdue taxes.  We prepared our client for his interview and instructed him as to the documents to bring including proof that he had a payment plan with the IRS to pay back his taxes. Our client appeared for his interview and the application was approved the same day.

Naturalization Application Approved - Issue with Good Moral Character
Location: Chicago, Illinois

Our client was a lawful permanent resident who was married to a U.S. citizen.  Three years had passed since her green card was issued, and she was eligible to file for citizenship because she was still married to a U.S. citizen.  She had one issue though because she had been charged with shoplifting a couple of years before.  Anyone applying for naturalization must demonstrate that he or she has been a person of good moral character for the statutory period (in this case it is three years for the spouse of a U.S. citizen).  Our client did not know if she was eligible to file because of this issue. She came to our office for help, and we recommended filing the application after seeing that her criminal case had been dismissed. We believed that her incident would not disqualify her for naturalization based on the regulations.

We filed the application in June 2012, and she was scheduled for an interview in October 2012.  We prepared our client for her interview and provided her with a list of documents to bring including joint documents to demonstrate that she was still in a valid marriage and certified copies of her criminal matter.  The interviewing officer agreed that our client's criminal issue did not disqualify her for naturalization, and her application was approved.
